TERMS AND CONDITIONS

These Terms and Conditions apply to purchases made through Arcana Australis and to all products, spiritual services, workings, commissioned services, consecrated items and other offerings supplied by Arcana Australis and its practitioners.

By placing an order with Arcana Australis, you confirm that you have read, understood and agreed to these Terms and Conditions.

1. ABOUT ARCANA AUSTRALIS

Arcana Australis is an Australian metaphysical and spiritual practice offering products and services which may include:

  • personalised spiritual and occult workings;

  • ritual and ceremonial services;

  • consecrated, prepared or spiritually aligned physical items;

  • amulets, talismans, vessels, portals, relics, crystals and altar items;

  • spirit, deity and current-based services;

  • custom and commissioned work; and

  • related metaphysical products and services.

Individual practitioners operating through Arcana Australis may work with different traditions, spirits, deities, currents and methods.

The methods used by each practitioner remain private.

2. AGE REQUIREMENT

You must be at least 18 years of age to purchase from Arcana Australis.

By placing an order, you confirm that you are 18 years of age or older.

Arcana Australis will not knowingly accept workings directed toward minors.

3. NATURE OF METAPHYSICAL SERVICES

Spiritual, occult and metaphysical practices are inherently subjective.

When purchasing a working or metaphysical service, you are purchasing the practitioner's time, preparation, materials, ritual work, spiritual practice and performance of the service described.

You are not purchasing a guaranteed external outcome.

No practitioner can guarantee the conduct, thoughts, emotions or decisions of another person, the actions of a spirit or deity, or the occurrence of any particular future event.

Spiritual currents, spirits, deities and other metaphysical forces are understood within their respective spiritual traditions to possess their own agency.

Accordingly, results may differ between clients and circumstances.

4. NO GUARANTEE OF RESULTS

Arcana Australis does not guarantee:

  • that a particular result will occur;

  • when a result will occur;

  • that another person will respond in a particular way;

  • that circumstances will develop exactly as requested;

  • financial, romantic, employment, legal or other material success; or

  • that a spiritual entity will act in precisely the manner anticipated by the purchaser.

Descriptions of intended purposes, properties, correspondences or outcomes explain the purpose for which a product or service is prepared. They are not guarantees of a particular result.

A lack of the result hoped for by the purchaser does not, by itself, establish that the purchased service was not performed.

Nothing in this section limits any rights you have under the Australian Consumer Law.

5. PERSONAL RESPONSIBILITY

You remain responsible for your own decisions, conduct and circumstances before, during and after any purchase.

Arcana Australis services are intended to supplement, rather than replace, practical action where practical action is appropriate.

You should obtain suitably qualified professional assistance for matters involving health, mental health, law, finance, personal safety or other professional concerns.

You must not delay or disregard appropriate professional assistance because of a metaphysical product, working or communication from Arcana Australis.

6. ORDERS AND ACCEPTANCE

Submitting payment does not require Arcana Australis or a particular practitioner to accept a case where circumstances make the requested service unsuitable.

Arcana Australis may decline or cancel an order where reasonably necessary, including where:

  • insufficient or inaccurate information has been provided;

  • the requested work falls outside the practitioner's practice;

  • the request involves a minor;

  • the request concerns a public figure whom the purchaser does not personally know;

  • the request appears connected with unlawful conduct;

  • the practitioner considers the requested service inappropriate or unsuitable;

  • the purchaser behaves abusively, threateningly or harassingly toward Arcana Australis or its practitioners; or

  • continuing the engagement is otherwise unreasonable.

Where Arcana Australis cancels an order before substantive work has commenced, the amount paid for the unperformed service will ordinarily be refunded.

Your order is not transferable to another person, target, objective or service without our agreement.

7. INFORMATION REQUIRED FOR PERSONALISED WORK

Certain services require information such as names, dates of birth, photographs, circumstances, intentions or other details reasonably required for the working.

You are responsible for ensuring that information supplied is accurate.

Arcana Australis is not responsible for errors or limitations arising from materially incorrect information supplied by the purchaser.

Where required information is not supplied, commencement or completion may be delayed until sufficient information is received.

8. COMMENCEMENT AND COMPLETION OF WORKINGS

Completion periods displayed on the website are estimates unless expressly stated otherwise.

The timing of spiritual work may depend upon matters including practitioner availability, preparation, ritual requirements, materials, lunar or planetary timing, weather, location requirements and the nature of the work commissioned.

Most standard workings are intended to be completed within the timeframe stated on the relevant product page or correspondence.

A working is considered supplied when the agreed ritual or metaphysical service has been substantially performed.

Any completion record, report or notification supplied by Arcana Australis records the performance of the service and is not a promise regarding subsequent results.

9. RITUAL METHODS AND PRACTITIONER DISCRETION

Purchasing a service authorises the selected practitioner to use their professional and spiritual judgement when performing the working.

Exact ritual procedures, invocations, offerings, seals, spirit communications, altar arrangements, ceremonial methods and other proprietary methods are not normally disclosed.

A practitioner may make reasonable adjustments to the method used where they consider this appropriate to the purpose of the purchased service.

The purchaser is commissioning an objective or category of work rather than directing every ritual step unless Arcana Australis has expressly agreed otherwise.

10. SPIRITS, DEITIES AND CURRENTS

References to demons, deities, spirits, ancestors, entities, energies, currents and other metaphysical beings or concepts reflect the spiritual framework within which the relevant practitioner operates.

Where a particular spirit, deity or current is specified in a listing, the practitioner will perform the service within that stated spiritual framework.

Any interpretation of communication, response, movement or influence associated with a spiritual entity remains a matter of spiritual belief and practice.

11. CUSTOM WORK

Custom services are prepared specifically for the purchaser.

The scope of a custom service is determined by the description agreed to before purchase or by the corresponding custom listing.

Additional objectives requested after commencement may require a separate service or additional payment.

A custom working does not become an unlimited consultation or continuing service unless this has been expressly included.

12. COMMUNICATION

Purchase of a product or working includes only the communication reasonably necessary to provide that product or service.

Unless otherwise stated, a purchase does not include unlimited consultation, ongoing case management or repeated interpretation of subsequent events.

Questions should be directly related to the purchased service and communicated respectfully.

Abusive, threatening, excessive or harassing communication may result in communication being restricted or the professional relationship being ended.

Where a service has already been completed, termination of further communication does not create an entitlement to a change-of-mind refund.

13. CANCELLATIONS AND CHANGE OF MIND

Please contact Arcana Australis as soon as possible if you wish to cancel an order.

Where a personalised working has not commenced, Arcana Australis may approve a cancellation subject to any reasonable non-recoverable costs already incurred.

Once meaningful preparation or performance of a personalised service has commenced, a change-of-mind cancellation may not be available.

Once a personalised working has been completed, refunds are not provided merely because:

  • the purchaser changes their mind;

  • circumstances later change;

  • the purchaser no longer wants the service;

  • another practitioner gives different advice;

  • the purchaser expected a different metaphysical response; or

  • the hoped-for external outcome has not occurred.

Physical products are likewise not required to be refunded solely because of change of mind unless Arcana Australis has expressly offered a change-of-mind return.

These provisions operate subject to your rights under the Australian Consumer Law.

14. AUSTRALIAN CONSUMER LAW

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy which cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with services, you may be entitled to cancel the service contract and receive a refund for the unused portion or compensation for its reduced value.

For major failures with goods, you may be entitled to choose a refund or replacement.

Where a failure is not major, Arcana Australis may have an opportunity to rectify the problem within a reasonable time as provided by law.

You may also have rights in relation to reasonably foreseeable loss or damage resulting from a failure to comply with an applicable consumer guarantee.

Nothing elsewhere in these Terms should be interpreted as limiting these statutory rights.

15. PHYSICAL PRODUCTS

Many Arcana Australis physical products are individually selected, prepared, consecrated, altered, handled or spiritually aligned.

Natural materials including stones, crystals, minerals, wood and other organic materials may display variations in colour, markings, texture, size and appearance.

Handmade, vintage, handmade-component and costume jewellery items may also display minor variations consistent with their nature.

Product photographs are intended to represent the item accurately, but screen settings, lighting and photography may result in minor differences in appearance.

Where a listing is for the exact item photographed, the purchaser will receive that item unless otherwise disclosed.

Where a listing represents a product type rather than an individual item, reasonable variation may occur.

16. ITEM CARE

The purchaser is responsible for appropriate care of physical products.

Jewellery and spiritually prepared items should be protected from circumstances reasonably likely to damage them, including excessive moisture, chemicals, perfumes, impact, heat or inappropriate storage where relevant.

Damage caused through misuse, accident, modification or unreasonable handling after delivery is not considered a product defect.

17. SHIPPING

Physical orders are shipped to the address provided at checkout.

You are responsible for ensuring that your delivery information is complete and accurate before dispatch.

Estimated delivery times are estimates only and may be affected by postal carriers, customs, weather, public holidays, international transport or circumstances outside Arcana Australis' reasonable control.

Once an item has been dispatched, carrier delays do not alter the metaphysical preparation of the item.

Where tracking is supplied, purchasers should monitor the tracking information and contact the relevant carrier promptly where necessary.

Any rights or remedies relating to delivery remain subject to applicable law.

18. INTERNATIONAL ORDERS, CUSTOMS AND IMPORT REQUIREMENTS

International purchasers are responsible for ensuring that items ordered may lawfully be imported into their country.

Customs duties, import taxes, handling charges and similar governmental charges imposed by the destination country are the responsibility of the purchaser unless stated otherwise.

Arcana Australis is not responsible for delays caused by customs authorities.

We reserve the right to decline to ship materials to locations where legal, postal, quarantine or import restrictions make shipment inappropriate.

19. LOST OR DAMAGED PARCELS

If an order arrives damaged, please contact Arcana Australis promptly and provide photographs of the packaging and item where reasonably required to assess the issue.

If tracking indicates that a parcel has been lost in transit, Arcana Australis will work with the carrier and provide the remedy required by applicable consumer law.

Claims involving incorrect addresses, refused deliveries or parcels returned because they were not collected will be considered according to the circumstances and applicable law.

20. DIGITAL MATERIALS AND RECORDS

Any reports, written records, instructions, photographs, downloadable files or other digital materials supplied with an order are licensed for the purchaser's personal use unless otherwise stated.

They may not be commercially reproduced, resold, republished, distributed, copied for sale or represented as the purchaser's own work without written permission.

21. INTELLECTUAL PROPERTY

Unless otherwise stated, Arcana Australis owns or licenses the content appearing on its website and materials, including:

  • written descriptions;

  • product names and original product concepts;

  • photographs and graphics;

  • ritual descriptions;

  • written reports;

  • guides and instructions;

  • branding;

  • original artwork; and

  • proprietary written material.

Nothing in a purchase transfers ownership of Arcana Australis intellectual property to the purchaser.

22. PRIVACY AND CONFIDENTIALITY

Information supplied for a personalised service will be used for purposes reasonably connected with providing the service, administering the order, communicating with the purchaser and complying with legal obligations.

Arcana Australis treats the personal circumstances of clients and ritual details as private.

Information may nevertheless be disclosed where reasonably necessary to payment processors, website or technology providers, postal carriers or professional advisers, or where disclosure is required by law.

23. THIRD-PARTY INFORMATION

Where you provide personal information about another person for the purpose of commissioning a service, you confirm that you have a lawful basis for providing that information and accept responsibility for your submission of it.

Do not provide highly sensitive information that is unnecessary for the requested service.

24. PROHIBITED USE

Arcana Australis products and services must not be used as a substitute for unlawful conduct or as a means of facilitating criminal activity, physical violence, stalking, harassment, self-harm or abuse.

Arcana Australis may refuse any request reasonably believed to create unacceptable legal, ethical or safety concerns.

25. PUBLIC FIGURES AND MINORS

Arcana Australis does not knowingly undertake personalised workings directed toward minors.

Arcana Australis may also refuse personalised workings involving celebrities, politicians or other public figures where the purchaser has no genuine personal relationship or direct private connection with that individual.

26. FINANCIAL, MEDICAL AND LEGAL MATTERS

Products or workings relating to prosperity, wellbeing, justice, employment, relationships or similar areas remain metaphysical services.

They do not constitute financial advice, investment advice, medical advice, psychological treatment, legal advice or another regulated professional service.

Decisions involving substantial financial, medical, psychological or legal consequences should be made with appropriate professional advice where necessary.

27. TESTIMONIALS AND CLIENT EXPERIENCES

Testimonials, reviews and accounts of client experiences describe individual experiences.

They do not guarantee that another purchaser will experience the same result.

Results and interpretations differ according to individual circumstances.

28. PAYMENT

Orders must be paid using the payment methods made available through the Arcana Australis website.

Prices are displayed in the currency identified at checkout.

You are responsible for any foreign exchange charges or fees imposed independently by your financial institution or payment provider.

Arcana Australis may cancel an order where payment is reversed, declined or reasonably suspected to be fraudulent.

29. CHARGEBACKS AND PAYMENT DISPUTES

If you believe there is a problem with an order, you are encouraged to contact Arcana Australis first so that the issue can be assessed.

Initiating a payment dispute does not alter whether a service was actually supplied.

Arcana Australis may provide payment processors or financial institutions with relevant evidence concerning the order, including the listing purchased, communications, completion records, dispatch records and other evidence reasonably required to respond to a dispute.

Nothing in this section prevents a purchaser from exercising any lawful right to dispute an unauthorised or genuinely disputed transaction.

30. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Arcana Australis is not liable for loss arising solely from a purchaser's reliance upon a hoped-for metaphysical outcome or from independent decisions made by the purchaser or third parties following a service.

Where liability cannot lawfully be excluded or restricted, these Terms do not attempt to exclude or restrict it.

Nothing in these Terms excludes liability or remedies which cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

31. WEBSITE INFORMATION

Arcana Australis takes reasonable care when preparing website information but may update listings, descriptions, prices, availability and policies from time to time.

Obvious typographical, technical or pricing errors may be corrected.

Where a material error affects an order before performance, Arcana Australis will contact the purchaser and provide an appropriate option, which may include proceeding on corrected terms or cancelling the affected order.

32. REFUSAL OF FUTURE SERVICE

Arcana Australis may decline future orders from a person where there is a reasonable basis for doing so, including previous abusive conduct, fraudulent activity, payment disputes made in bad faith, repeated boundary violations or misuse of Arcana Australis services.

This does not affect obligations attached to an existing accepted order or rights arising under applicable law.

33. CHANGES TO THESE TERMS

Arcana Australis may update these Terms and Conditions from time to time.

The Terms applying to a transaction will ordinarily be those published when the relevant order was placed, except where a change is required by law or expressly agreed with the purchaser.

The current version will be published on the Arcana Australis website with its revision date.

34. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary without affecting the remaining provisions.

35. GOVERNING LAW

These Terms and Conditions are governed by the laws applicable in Tasmania, Australia, together with applicable Commonwealth legislation.

Subject to any rights a consumer has to bring proceedings elsewhere under applicable law, disputes relating to these Terms are subject to the jurisdiction of the courts and tribunals having jurisdiction in Tasmania.

36. AGREEMENT

By completing a purchase through Arcana Australis, you acknowledge that:

  • you are at least 18 years of age;

  • you have read the relevant product or service description;

  • you understand the metaphysical and subjective nature of the services offered;

  • you understand that payment purchases the product or performance of the service rather than a guaranteed external result;

  • you accept the applicable preparation, completion, communication and cancellation conditions;

  • you accept responsibility for the decisions you make in connection with your purchase; and

  • you agree to these Terms and Conditions.

Nothing in this agreement limits any statutory consumer rights that cannot lawfully be excluded.
